1. Introduction

Welcome to JuanSure, an online insurance marketplace operated by Serivus, OPC, a One Person Corporation duly registered under the laws of the Republic of the Philippines, with principal address in Bacolod City.

These Terms and Conditions ("Terms") govern your access to and use of our website, platform, products, and services (collectively, the "Service"). By accessing or using JuanSure, you agree to be legally bound by these Terms. If you do not agree, please discontinue use of the Service immediately.

We may update, revise, or amend these Terms at any time by posting changes on this page. Your continued use of the Service following the posting of changes constitutes acceptance of those changes.

2. Definitions

For purposes of these Terms:

• "JuanSure" / "we" / "us" / "our" – refers to Serivus, OPC and its platform.

• “User” / “you” / “your” – refers to any individual or entity accessing or using the Service.

• "Partner Insurers" – refers to licensed insurance companies in the Philippines whose products are listed on JuanSure.

• "Service" – refers to the JuanSure platform and all related tools, features, and services made available to Users.

3. Our Role

1. JuanSure is an insurance marketplace and comparison platform. We are not an insurance company, underwriter, broker, or financial advisor.

2. All insurance policies displayed on JuanSure are issued and underwritten solely by our Partner Insurers. We do not guarantee acceptance, coverage, or claims.

3. Our role is limited to:

   • Displaying insurance products for comparison purposes.

   • Facilitating referrals and connections between Users and Partner Insurers.

   • Providing general information about insurance products.

4. JuanSure will receive commissions and/or service fees from Partner Insurers when a User purchases a policy through the platform. This does not affect the premium payable by the User.

4. Eligibility & Use of Service

1. You must be at least 18 years old and legally capable of entering into binding contracts under Philippine law to use the Service.

2. You agree to use the Service only for lawful purposes and in compliance with these Terms.

3. You must not:

   • Provide false, misleading, or incomplete information.

   • Use the Service for fraudulent or illegal activity.

   • Interfere with the proper operation of the platform (e.g., hacking, introducing malware).

   • Impersonate another person or misrepresent your identity.

5. Accuracy & Availability of Information

1. We strive to ensure that information about insurance products is accurate and up to date. However, we do not warrant or guarantee the completeness, accuracy, reliability, or availability of any information on the platform.

2. In case of discrepancies, the official policy terms and conditions of the relevant Partner Insurer shall prevail.

3. We reserve the right to modify, suspend, or withdraw the Service (in whole or in part) at any time without notice.

6. Third-Party Links & Services

1. The Service may contain links to websites, services, or tools operated by third parties, including Partner Insurers. These are provided for your convenience only.

2. We have no control over, and accept no responsibility for, the content, policies, or services of third-party websites.

3. Transactions with third parties (including Partner Insurers) are strictly between you and the third party.

7. Intellectual Property

1. All content, branding, design, software, and features on JuanSure are the exclusive property of Serivus, OPC, unless otherwise stated.

2. You may not copy, reproduce, distribute, or exploit any part of the Service without our express written permission.

8. Limitation of Liability

1. JuanSure provides the Service on an "as is" and "as available" basis. We make no warranties, express or implied, regarding uninterrupted access, suitability, or error-free use.

2. To the fullest extent permitted by law, JuanSure shall not be liable for:

   • Any loss, damage, or claim arising from your reliance on information on the platform.

   • Errors, omissions, or delays caused by Partner Insurers.

   • Any claims, disputes, or issues related to the purchase, performance, or claims of insurance policies.

   • Any indirect, incidental, special, or consequential damages, including lost profits, data, or business opportunities.

3. If liability is established despite the above, our liability shall not exceed the amount (if any) paid by you directly to JuanSure for use of the Service.

9. Indemnity

You agree to indemnify and hold harmless Serivus, OPC, its officers, employees, and agents from and against any claims, damages, losses, liabilities, or expenses arising from your use of the Service, breach of these Terms, or violation of law or third-party rights.

10. Privacy & Data Protection

We respect your privacy. The collection, use, and protection of your personal data are governed by our separate Privacy Policy, which complies with the Data Privacy Act of 2012 and relevant Insurance Commission guidelines.

11. Suspension & Termination

1. We may suspend or terminate your access to the Service if you violate these Terms or engage in suspected fraudulent activity.

2. Termination will not affect any rights or obligations accrued before the termination date.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of the Philippines. Any disputes shall be submitted exclusively to the proper courts of Bacolod City, Philippines.

13. Entire Agreement

These Terms, together with our Privacy Policy and any notices posted on the Service, constitute the entire agreement between you and JuanSure. They supersede all prior agreements, whether oral or written.
